1. Acceptance of Terms

By accessing or using the SmallGroupsHQ platform ("Service"), including the web application at smallgroupshq.com and the SmallGroups mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

"You" refers to the individual or organization accessing the Service. If you are using the Service on behalf of a church, ministry, or other organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

SmallGroupsHQ is a software-as-a-service platform that provides tools for churches and faith-based organizations to manage small group ministries. Features include group discovery, member management, leader qualification workflows, messaging, attendance tracking, and administrative tools.

3. Accounts and Registration

To use the Service, you must create an account with a valid email address or phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Organization administrators are responsible for managing their organization's account settings, member access, and data. Each organization operates as a separate tenant within the platform.

4. Subscription and Payment

SmallGroupsHQ offers multiple subscription tiers. The Starter plan is available at no cost. Paid plans (Growth and Church) are billed monthly or annually as selected at the time of purchase.

• Free Trial: Paid plans include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial.
• Billing: Subscriptions automatically renew at the end of each billing period. You authorize us to charge your designated payment method for recurring fees.
• Cancellation: You may cancel your subscription at any time through the billing settings in your account. Access continues through the end of the current billing period.
• Refunds: Refunds are handled on a case-by-case basis. Contact support for refund requests.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload or transmit harmful content, including malware, spam, or content that violates the rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to collect personal information about individuals without their consent
• Interfere with or disrupt the integrity or performance of the Service
• Resell, sublicense, or redistribute the Service without written permission

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You retain ownership of all data you upload to the Service ("Your Data"). You grant SmallGroupsHQ a limited license to use Your Data solely for the purpose of providing the Service to you.

Organization administrators are responsible for ensuring that their use of member data complies with applicable privacy laws and regulations.

7. Intellectual Property

The Service, including its design, features, code, and branding, is owned by SmallGroupsHQ and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

Organizations may upload their own branding (logos, colors) to customize the member experience. You represent that you have the right to use any branding you upload.

8. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance when possible. Support response times vary by subscription tier.

9. Limitation of Liability

To the maximum extent permitted by law, SmallGroupsHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SmallGroupsHQ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if continued use would pose a risk to the Service or other users. Upon termination, you may request an export of Your Data within 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas.
